§ 36-44. Holder's records and reports.

  • (a)

    Every holder of a certificate of public convenience and necessity shall retain and preserve all drivers' manifests in a safe and orderly fashion for at least one (1) year following the year for which the manifests were completed, and upon request such daily manifests shall be available to the city. At the conclusion of each month, a monthly report shall be completed by each holder of a certification upon a form provided by the director of public works. This form shall request data such as the average number of taxicabs actually in operation during the month, the number of trips made during the month, miles driven, gasoline consumed, the number of in-city versus out-city calls, the number of accidents both chargeable and nonchargeable, the nature of any major problems encountered during the month and such other information as may be deemed desirable by the city.

    (b)

    Every holder shall keep accurate records of receipts from operations, operating and other expenses, capital expenditures and such other operating information as may be required by the city. Every holder shall maintain the records containing such information and other data required by this chapter at a place readily accessible for examination by the city.

    (c)

    In addition to the monthly reports to be submitted to the director of public works, every holder shall summarize his yearly operations and submit an annual report of receipts, expenses and statistics of operation to the director of public works in accordance with a uniform system prescribed by the city.

    (d)

    It shall be mandatory for all holders to file with the director of public works copies of all contracts, agreements, arrangements, memoranda or other writings relating to the furnishing of taxicab service to any individual, hotel, theater, hall, public resort, railway or bus station or other place of public gathering, whether such arrangement is made with the holder or any corporation, firm or association with which the holder or any corporation, firm or association with which the holder may be interested or connected. Failure to file such copies within seven (7) days of their execution shall be sufficient cause for the revocation of a certificate of any offending holder or the cancellation of any taxicab stand privileges.

    (e)

    Every holder shall maintain on file with the director of public works his name, business address, garage address, all business telephone numbers listed in his name, and the names of all drivers, their license numbers and addresses, and shall within forty-eight (48) hours after any change in connection therewith report such changes to the director of public works.

    (f)

    Every holder shall keep a description of his equipment at all times on file with the director of public works and police chief showing the make, model, passenger capacity, date of acquisition, from whom acquired, the motor number and serial number, and the state and city license number of each taxicab which is authorized by the holder's certificate. No equipment shall be substituted for that described in the holder's certificate until it has been inspected and approved by the city, and the substitution or addition of such equipment has been endorsed on the holder's certificate issued under this article.
